Beta Terms of Service

These Beta Terms of Service (“Terms”) govern your access to and use of Dusted, including the iOS beta distributed through Apple TestFlight, the Android beta distributed through Google Play, and related beta materials and support resources that link to these Terms (together, the “Beta App”).



These Terms are between Kialo GmbH of Joachimsthaler Straße 1-4, 10623 Berlin, Germany (“Kialo,” “we,” “us,” or “our”), and you.

These Terms work together with our Beta Privacy Policy and Beta Testing Consent and Confidentiality Agreement. If there is a direct conflict about privacy or personal data, the Beta Privacy Policy controls. If there is a direct conflict about interviews, surveys, recordings, or compensation for beta research participation, the Beta Testing Consent and Confidentiality Agreement controls. Otherwise, these Terms control your use of the Beta App.


1. Acceptance

By downloading, installing, accessing, or using the Beta App, or by clicking to accept where presented, you agree to be bound by these Terms.

You must accept these Terms before you use the Beta App or create, upload, or share any content through it.
If you do not agree to these Terms, do not use the Beta App.

2. Eligibility

You may use the Beta App only if:


  1. You are at least 18 years old.
  2. You are legally able to agree to these Terms.
  3. Your access has not been suspended or terminated by us.
  4. You are not barred from using the Beta App under applicable law.

Each adult participant must accept these Terms personally.

Minors may not participate in the beta and may not be invited, added, or onboarded into the beta.


If we learn that you are under 18, or that you invited or allowed a minor to participate, we may suspend or terminate your access immediately and handle your data as described in the Beta Privacy Policy and the Beta Testing Consent and Confidentiality Agreement.

3. Beta status and beta period

The Beta App is a pre-release product. It may be incomplete and may contain bugs, errors, outages, missing features, or data loss.

The beta is expected to run between May and June 2026, but we may start later, extend it, shorten it, pause it, or end it earlier. Where reasonably possible, we will give advance written notice.

We may change, add, remove, disable, or discontinue any feature of the Beta App at any time.

We are not required to release a final version of the Beta App, to continue any feature, or to make the Beta App generally available.

These Terms apply only to this beta, including any optional continued use of the beta version of the app after the formal testing period, unless we later state otherwise in writing.

4. Limited license

Subject to these Terms, we grant you a limited, personal, revocable, nonexclusive, nontransferable, non sublicensable license to install and use the Beta App during the beta period, or beyond if you voluntarily decide to continue using the beta version of the app, for personal evaluation and household use only.


The Beta App is licensed, not sold.


Your license ends automatically if these Terms end, or if your access is suspended or terminated.

Except to the extent applicable law does not allow the restriction, you may not:


  1. Copy, modify, distribute, sell, rent, lease, lend, sublicense, or commercially exploit the Beta App.
  2. Reverse engineer, decompile, disassemble, or attempt to discover source code.
  3. Bypass, interfere with, or disable any security or access control feature.
  4. Use the Beta App for benchmarking, competitive analysis, or any public comparison without our written permission.

5. Accounts, login details, and device security

You must provide accurate information when creating or using an account and keep it up to date.
You are responsible for:


  1. Keeping your device and login details secure.
  2. Activity that occurs under your account, except to the extent caused by our failure to maintain reasonable safeguards.
  3. Notifying us promptly if you suspect unauthorized access or misuse.


We may require you to install updates to continue using the Beta App.

6. Household use and shared spaces

The Beta App is intended for use within a single household. It is not designed to connect you with people outside your household.

The Beta App allows a household owner to invite, remove, or manage members. The owner can restrict shared access in the household settings.

Shared household content that the product is designed to share, such as tasks in the Journal, is visible to participating household members.

Observations are private. They are not shared with other household members through the Beta App.
If you leave a household, delete your account, or are removed from a household, shared household content may remain visible to the household for continuity, but we may remove or replace your direct identifiers in shared records where reasonably possible.

Please avoid entering real names or highly sensitive details about nonparticipants if you do not want them to be seen by the core beta team or processed by our service providers, including AI processing providers, for the purposes described in the Beta Privacy Policy.

7. User content

“User Content” means content you create, upload, submit, record, generate, or share through the Beta App, including but not limited to tasks, observations, templates, feedback, voice inputs, transcripts, AI-generated task titles, and related structured outputs.

You keep any ownership rights you have in the content you create or upload to the Beta App.

You grant us a worldwide, nonexclusive, royalty-free license to host, store, back up, copy, process, display, transmit, analyze, structure, categorize, and otherwise use your User Content as needed to:

  1. Operate and support the Beta App.
  2. Maintain household functionality and shared household history.
  3. Provide AI-assisted processing, including transcription and converting voice or text entries into structured tasks, observations, templates, feedback, or related app outputs.
  4. Review, test, debug, improve, secure, and administer the Beta App.
  5. Conduct beta research described in the Beta Testing Consent and Confidentiality Agreement.
  6. Comply with law and protect rights, safety, and security.


By using the Beta App, you acknowledge that User Content submitted for AI-assisted processing will be transmitted to our AI-assisted providers for processing. We do not permit those providers to use your content to train their general-purpose AI models.

You represent that:


  1. You have the rights needed to submit your User Content.
  2. Your User Content does not violate law or the rights of others.
  3. You will not use the Beta App to upload or share unlawful, threatening, harassing, hateful, infringing, or otherwise harmful content.

8. Feedback

If you send us ideas, suggestions, bug reports, feature requests, interview responses, survey responses, or other feedback, you agree that we may use that feedback without restriction and without additional payment, approval, or attribution, except where applicable law requires otherwise.


This section does not limit any separate confidentiality obligation that applies to nonpublic beta information under Section 9.

9. Confidentiality and no public sharing

The Beta App and any nonpublic information about it are confidential. This includes nonpublic features, designs, screenshots, bugs, product direction, testing materials, strategy, and other information you learn through the beta.

Unless we give you written permission, you must not:


  1. Post screenshots, recordings, reviews, or descriptions of the Beta App on social media, websites, blogs, forums, app stores, or any other public or third-party platforms where unauthorized users may access or learn about the Beta App.
  2. Disclose nonpublic information about the Beta App to the press or third parties.
  3. Publish benchmarks, comparisons, or bug details.
  4. Share beta builds or access credentials with anyone else.


This confidentiality obligation continues until the relevant information becomes public through us, or until we confirm in writing that it is no longer confidential.
This section does not stop you from using private feedback channels that Apple, Google, or we make available for beta feedback.

10. Acceptable use, safety, reporting, and blocking

You may not use the Beta App to:


  1. Harass, threaten, stalk, intimidate, coerce, shame, or abuse anyone.
  2. Engage in coercive control or misuse household visibility, reminders, assignments, or other features to monitor or pressure another person.
  3. Upload illegal, hateful, violent, sexually exploitative, infringing, or otherwise harmful content.
  4. Impersonate another person or misrepresent your identity or authority.
  5. Access, attempt to access, or interfere with another person’s account, household, or data without authorization.
  6. Scrape, probe, test, or attack the Beta App or our systems.
  7. Violate these Terms, the Beta Privacy Policy, or the Beta Testing Consent and Confidentiality Agreement.

This beta is not an emergency service or safety tool. We do not monitor household interactions in real time. If you are in immediate danger, contact local emergency services.


If you see objectionable content, misuse, or harmful behaviour connected to the Beta App, you can report the content or the user in the app via Feedback in the app settings.


You may also contact us promptly at support@dusted-app.com if you experience or observe harmful conduct connected to the Beta App.


We may review reported content or conduct and take action we consider appropriate, including removing content, restricting features, suspending a household, or terminating access.

11. Privacy and deletion

Our Beta Privacy Policy is incorporated into these Terms and explains how we collect, use, share, retain, deidentify, and delete personal information.


During active testing, the core beta team may review identifiable content and usage through internal tools, and User Content may be processed by our service providers, including AI processing providers,  as described in the Beta Privacy Policy and the Beta Testing Consent and Confidentiality Agreement.

Deleting the Beta App from your device does not delete your account. You can delete your account from within the app. Upon deleting your account, we will transfer ownership of any households with other members to one of them, and will de-identify all your contributions.

12. Third party services and platforms

Some beta activities may use third party services, such as scheduling, interview transcription, email, hosting, or payment providers.

Your use of Apple TestFlight, Google Play, Calendly, Open AI, Gemini, and any other third party services used in connection with the beta may also be subject to those providers’ own terms and privacy notices.

We are not responsible for third party services, except to the extent required by applicable law.

13. Compensation

These Terms do not by themselves create any right to compensation.

Any compensation for separate beta research activities, if offered, is governed only by the Beta Testing Consent and Confidentiality Agreement and related written beta communications.

If no separate written compensation terms are provided, no compensation is owed.

14. Suspension, termination, and beta changes

We may suspend, restrict, or terminate your access to the Beta App at any time, with or without notice, if we believe that:


  1. You violated these Terms or the terms specified in other beta materials.
  2. You created a privacy, security, or safety risk.
  3. You are under 18 or involved a minor in the beta.
  4. We are changing or ending the beta.
  5. Continued access would expose us, other users, or the beta to legal, operational, or security risk.

If your access ends:


  1. Your license ends immediately.
  2. You must stop using the Beta App.
  3. You must delete any beta materials in your possession that remain confidential.
  4. Your data will be handled under the Beta Privacy Policy and the Beta Testing Consent and Confidentiality Agreement.

15. No emergency use and no advice

The Beta App is not intended for emergency, medical, mental health, childcare, legal, financial, employment, or safety-critical use.

Any task record, burden sharing information, statistics, or other app outputs are for general informational purposes only. They are not legal proof, legal advice, relationship advice, financial advice, or professional advice of any kind.

We are not responsible for interpersonal disputes, household decisions, or real world outcomes that arise from or relate to use of the Beta App.

16. Disclaimer of warranties

To the fullest extent permitted by law, the Beta App is provided “as is” and “as available.”

We do not guarantee that the Beta App will be uninterrupted, error free, accurate, complete, available at any particular time, or free from data loss.

We do not guarantee that any feature will continue, that any issue will be fixed, or that a final version will ever be released.

Nothing in these Terms excludes rights that cannot be excluded under applicable law.

17. Limitation of liability

To the fullest extent permitted by law, Kialo and its affiliates, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, goodwill, use, or data, arising out of or related to the Beta App.



This section applies only to the extent permitted by applicable law.

18. Apple TestFlight terms

If you use the Beta App on Apple platforms through TestFlight:

These Terms are between you and us, not Apple. We, not Apple, are responsible for the Beta App and its content. Apple has no obligation to provide maintenance or support for the Beta App. Any questions, complaints, or claims about the Beta App should be directed to us.

You must comply with applicable Apple platform terms when using the Beta App.

Apple’s TestFlight terms and any applicable beta license agreement for the TestFlight app may also apply.

19. Google Play Internal Testing terms

If you use the Beta App through Google Play Internal Testing, your use of Google Play is also subject to Google’s own terms, policies, and privacy terms.

Any store features, testing track tools, account features, or other Google Play functions provided by Google are governed by Google’s terms, not these Terms.

These Terms do not limit any rights or obligations that apply under Google Play’s own terms or policies.

20. Changes to these Terms

We may update these Terms from time to time.

If we do, we will post the updated version, update the “Last updated” date, and, if the changes are material, use reasonable efforts to notify you in writing.

If you continue to use the Beta App after the updated Terms take effect, you agree to the updated Terms.

If you do not agree to the updated Terms, you must stop using the Beta App.

21. Governing law and disputes

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Federal Republic of Germany.

Before initiating formal proceedings, you agree to resolve any dispute amicably by contacting us at legal@dusted-app.com and allowing a reasonable period for response.

We are not willing and not obligated to participate in dispute resolution proceedings before a consumer conciliation board.

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer and the law of the country where you habitually live gives you mandatory protections, nothing in these Terms takes away those protections. Any dispute relating to these Terms or the Beta App will be brought before the courts that have jurisdiction under applicable law.

22. General

If any part of these Terms is unenforceable, the rest remains in effect.

These Terms, the Beta Privacy Policy, and the Beta Testing Consent and Confidentiality Agreement are the full agreement between you and us for this beta, except for any separate written agreement that expressly says it overrides part of them.

Our failure to enforce any part of these Terms is not a waiver.

You may not assign or transfer these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets.
